Unitary Business Test

The New Jersey Div. of Taxation discusses the unitary business test. A newly issued technical bulletin addresses how the state will apply the test for tax years that end on or after July 31, 2019. Entities that meet the definition of a unitary business will be required to be included in a combined tax return. A “unitary business” is defined, in part, as “a single economic enterprise made up either of separate parts of a single business entity or of a group of business entities under common ownership that are sufficiently interdependent, integrated and interrelated through their activities so as to provide a synergy and mutual benefit.” Read TB-93.
