The New Jersey Division of Taxation explained that the marketplace facilitator rules don’t apply to someone who simply sells advertising space and isn’t otherwise involved in the transaction for the tangible personal property or services that are being advertised. The marketplace facilitator rules apply only when the listing fee or advertising fee is connected to the actual sale of tangible personal property and services. © 2019
